(“eFraud Services Inc.”, “We, “Us” “Our”) collects and uses your Personal Information, how you can control its use, and describes our practices regarding information collected from our Website, SaaS Application, Social Media pages, and HTML-formatted email messages (collectively, the “Services”).

 

Before you submit any information on or through the eFraud Services Inc. site or account portal or use eFraud Services Inc. products or services, please carefully review this policy. You acknowledge and understand that, by using any part of the eFraud Services Inc. site or service, your continued use of the eFraud Services Inc. site, and/or continued provision of information to us will be subject to the terms of the then-current Privacy Policy.

 

When we say “You” or “Your” we are referring to any User or entity that is viewing our website or App or has registered for an account with Us to use the Services.

 

This policy applies to the information we collect:

  • On this Website.
  • In email, text, and other electronic messages between you and Our Website.
  • Through our SaaS Application (the “Service”).
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

Where we act as a processor for our clients and process personal data of residents in the EEA and UK, we will ensure compliance with the GDPR and other applicable EU data protection laws.

We may use cookies to collect data automatically about your use of our website or for advertising.

 

We can share the data we collect from you with those outside of eFraud Services Inc. if they are a service provider for eFraud Services Inc. (and have to follow our requirements) or if we’re legally required to share it with those outside of eFraud Services Inc.

 

This Policy does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Us or any third party (including our affiliates and subsidiaries); or
  • any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Website.

We at eFraud Services Inc. know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby authorize eFraud Services Inc. to collect, use, and share your information for the purposes identified herein and on the Site.

 

Remember that your use of eFraud Services Inc. Services is always subject to the Terms of Service, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Service.

The Services may provide links to or the ability to connect with non-eFraud Services Inc.  websites, services, social networks or applications. Clicking on those links or enabling those connections might allow the third party to collect or share information about you. Those third-party websites or services are beyond eFraud Services Inc.’s control. eFraud Services Inc. advises you to check the privacy policies and terms of use of any non-eFraud Services Inc. websites or services before providing any of your Personal Information to them.

This Privacy Policy is effective with respect to any data that we have collected, or collect, about and/or from you, according to our Terms of Use.

 

  1. WHAT DOES THIS PRIVACY POLICY COVER?

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage such as advertisers and third parties that help Us maintain and improve our Services. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below in Section 9.

 

As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from anyone under the age of 18, we will delete that information as quickly as possible.   1. Will eFraud Services Inc. ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice in the app, sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all the changes.

 

  1. What Information does eFraud Services Inc. collect?

(a) Information You Voluntarily Provide to Us

 

When you sign up for the Services by means of the registration process and use the Services, or consult with a member of our customer service team, send us an email, or communicate in any manner with us, you are knowingly and voluntarily providing us information that we collect. That information might include the name of your company, address, telephone number, contact person, email, and information about the fees paid by Clients to use our Services. Some of the information uploaded by Clients to Our Services includes bank statements and other financial documents that may contain personally identifiable information such as names, addresses, and banking and financial account numbers of the targets of Clients’ investigations. By giving us this information, you consent to this information being collected, used, or disclosed to us in the United States and stored by us, as set forth in our Terms of Service and in this Privacy Policy.

We may communicate with you if you’ve provided us with the means to do so. For example, if you’ve given us your email address, we may email you about your use of the Services. Also, we may receive confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive communications from us, please indicate your preference by unsubscribing at the bottom of the email and/or through the settings menu in the application if the option is available.

 

(b) What Information do we collect automatically?

Cookies and Tracking. We and our partners may use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and gather demographic information about our user base. Users can control the use of cookies at the individual browser level.

 

(c) Web Beacons, GPS and Geotracking

Web pages might contain an electronic file which is called a web beacon, that allows a website to count the number of users who have visited that page or to access certain cookies. We might use web beacons in the following ways:

(1) HTML Mail

eFraud Services Inc. might include web beacons in HTML-formatted email messages that eFraud Services Inc., or its agents, or affiliates send to determine what specific email messages were opened and to note whether a message was acted upon.

 

As we adopt additional technologies, we may also gather information through other methods. Please note that you can change your settings to notify you when a cookie is being set or updated or to block cookies altogether. Please note that by blocking, disabling, or managing any or all cookies, you may not have access to certain features or offerings of the Services.

 

(d) Online Analytics and Advertising

We may use third-party web analytics services (such as those of Google Analytics) on our Services to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; and provide certain features to you.   1. Use and Disclosure of Personal Information

We might use and disclose Personal Information only for the following purposes:

(a) To communicate with our Clients about their accounts and provide Client support and related information about customer/member accounts.

(b) To send you System Alert messages. We may need to inform you of any temporary or permanent changes to our Services, such as planned outages, new and additional features, version updates, releases, abuse warnings, and/or changes to our Privacy Policy.

(c) To enforce compliance with our Terms of Use and applicable laws.

(d) To protect the rights and safety of our Clients and third parties, as well as our own.

(e) To meet legal requirements, including complying with subpoenas, court orders, discovery requests, and other legal matters.

(f) To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.

(g) To prosecute and defend a court, arbitration, or similar legal proceeding.

(h) To respond to lawful requests by public authorities, which include court orders, lawsuits and subpoenas that may relate to national security or law enforcement requirements or requests.

(i) To provide support and improve the Services we offer. This may include our use of the data that you provide us to enable You to use the Services.

(j) To provide suggestions to Users.

 

  1. Data Collected for and by our Users

Pursuant to the uses of Personal Information mentioned in Paragraph 6, we may transfer Personal Information of you to companies that assist eFraud Services Inc. in providing or supporting our Services. As part of our Services, we may use and incorporate into features information you have provided, we have collected from you. We may share this information with third parties consistent with the approved uses above.

We will retain the Personal Information we process on behalf of our Users for as long as needed to provide our Services or to comply with our legal obligations, to prevent abuse, or to enforce any of our agreements.

 

  1. Will eFraud Services Inc. Disclose or Share Any of the Personal Information it Receives?

We do not rent or sell your Personal Information in personally identifiable form to anyone, provided certain Personal Information may be transferred in connection with business transfers, as described below. We may share your Personal Information with third parties as described below.

 

  1. Third Parties

We may disclose or share your Personal Information with the following types of third parties for the purposes described in this policy:

 

(a) Service providers. With Service Providers. We do not share your personal information with unaffiliated third parties except agents or companies acting on eFraud Services Inc.’s behalf who perform functions to enable eFraud Services Inc. to provide its Services. This means we may share information about you that can identify you personally with service providers or agents in order to have them perform on our behalf any of the activities we are permitted to conduct under this Privacy Policy and our Terms of Use including but not limited to website design, sending email communications, fraud detection and prevention, customer care, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, providing customer service or performing analytics. These third parties are acting on our behalf so while they may have access to your information, they’re required to follow our instructions and meet the standards explained in our Privacy Policy when handling information about you that we provide them.

 

Protection of eFraud Services Inc. and Others: We reserve the right to access, read, preserve, and disclose any information that we [reasonably] believe is necessary to comply with the law or any court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of eFraud Services Inc., our employees, our users, or others.

 

(b) With Legal and Law Enforcement. We may share information collected about you with law enforcement, governmental agencies, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other Website or Services user to legal liability or if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

 

(c) In Connection with a Change of Control. We may transfer or disclose your information in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company.

 

(d) To fulfill the purpose for which you provide it.

 

(e) For any other purpose disclosed by us when you provide the information.

 

(f) With your Consent. We may share your information with your consent or at your specific direction.

 

  1. Is Personal Information about me secure?

We take reasonable and appropriate measures to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, considering the risks involved in the processing and the nature of the Personal Information. Regardless of the precautions taken by us, we cannot ensure or warrant the security of any information you transmit to us and there is no guarantee that there will be no unauthorized access, use, disclosure or processing of personal information or that there will not be any breach of our physical, technical, or managerial safeguards.

Your account may be protected by a username and password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanisms appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

You may access, and, in some cases, edit or delete the following information you’ve provided to us:

– user profile information, including images you have uploaded

  1. WHAT CHOICES DO I HAVE?

You can always opt not to disclose information to us, but keep in mind some information is needed to register with us or to take advantage of some of our features.

 

You may be able to add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may delete your account by sending an email to support@efraudservices.com and requesting termination of your account. Some information may remain in our records after your deletion of such information from your account.

  1. We Are Located in the United States

Our offices are in the United States.

 

  1. Special Rules for Children. Because of federal law, we are not permitted to knowingly collect any personal information from a child under the age of thirteen without the consent of that child’s parent or guardian. The statements in this Privacy Policy about our collection and use of personal information also apply to our treatment of personal information from children under the age of thirteen. Some elements of our Services may require the submission of PayPal payment information along with personal information in connection with a purchase; other elements of our Services require the submission of personal information to access or use the Services. Except in certain cases where limited contact information may be collected and not retained, these elements of our Services are not available to children under the age of thirteen. If a child who we know to be under the age of thirteen and for whom we have not received parental consent attempts to utilize a service on our Services that is not available to children, he/she will not be able to access it and may receive a message which relays that he/she is not eligible for such a feature.
  1. CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address to:

  • Send information, respond to inquiries, and/or other requests or questions.
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred

To be in compliance with CANSPAM we agree to the following:

  • NOT use false, or misleading subjects or email addresses
  • Identify the message as an advertisement in some reasonable way
  • Monitor third-party email marketing services for compliance, if one is used.
  • Honor opt-out/unsubscribe requests quickly
  • Allow users to unsubscribe by using the link at the bottom of each email

If at any time you would like to unsubscribe from receiving future emails, you can follow the instructions at the bottom of each email, and we will promptly remove you from all correspondence.

 

  1. CALIFORNIA PRIVACY NOTICE

This Notice supplements the information contained in eFraud Services Inc.’s Privacy Statement and is applied solely to residents of the State of California (“consumers” or “you”). eFraud Services Inc. adopts this Notice and Statement to comply with the California Consumer Privacy Act (CCPA) of 2018, as amended from time to time. Any terms defined in the CCPA have the same meaning when used in this Notice and Statement. This Notice and Statement does not reflect our collection, use, or disclosure of California residents’ personal information where an exception under the CCPA applies.

 

California law defines “personal information” broadly as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. This notice also uses that definition for personal information.

Please see the “What Information does eFraud Services Inc. Collect” section earlier in this Privacy Statement to understand the sources from which we get personal information.

We list below categories of personal information we collect about California residents and that we have collected in the preceding 12 months. For each category of personal information we have collected, we have included the reference to the enumerated category or categories of personal information in the definition of this term in the CCPA that most closely describes such personal information.

  • Identifiers: First and last name, address/billing address, telephone number, email address, username, and IP address.
  • Personal information categories listed in the California Customer Records Act (Cal. Civ. Code § 1798.80(e)): First and last name, date of birth, address, telephone number, bank account number, and other financial information.
  • Characteristics of protected classifications under California or federal law: Age, gender, diversity, and inclusion information.
  • Biometric identifier: Video and voice recordings.
  • Internet or network information: Browser type, internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data.
  • Geolocation data: The approximate physical location associated with your IP address.
  • Professional or employment information: Your job title and organizational affiliation, professional certification details, and employment history.
  • Sensory information: Video and voice recordings.

Sharing of personal information

 

Please see Paragraphs 5 and 8 earlier in this Privacy Statement to understand how we may disclose your personal information.

California law provides you with the following rights:

  • Access: You may request access to the specific pieces of personal information collected about you over the past 12 months.
  • Deletion: You may request deletion of your personal information. We may retain personal information as required or permitted by law and will maintain a copy of your deletion request.
  • Disclosure: You may request disclosure of the categories of personal information we collect, the purposes for which we collect, sell, or disclose that information, and the categories of third parties with whom we share the information.
  • Non-Discrimination: You may not be discriminated against because you exercise any of your rights under the CCPA, in violation of California Civil Code § 1798.125.

To exercise your California privacy rights, and choices, please follow the instructions below:

  • How to Request That We Identify or Provide You Access to Personal Information: You may request that we identify or provide you with access to your personal information. To do so, please email us at: support@efraudservices.com. In response to a request to identify your personal information, we will identify to you (1) the categories of personal information we have collected, disclosed or sold about you in the last 12 months, (2) the categories of sources from which the personal information was collected, (3) the business purpose for which we use this information, and (4) the categories of third parties with whom we share or have shared your personal information in the last 12 months. In response to a request to access your personal information, we will produce an “Access Report” detailing the personal information we have collected, disclosed, and/or sold about you. This Access Report will be delivered by mail or electronically at your request.
  • How to Request Deletion of Personal Information: You may request that efraud services delete the personal information it has collected and/or maintained about you. To do so, please email: support@efraudservices.com. Note, we may need to retain certain personal information as permitted by law, such as to complete the transaction for which the personal information was collected, provide a requested good or service, detect security incidents, protect against malicious, deceptive, fraudulent or illegal activities, comply with legal obligations or to enable solely internal uses that are reasonably aligned with your expectations or lawful within the context in which you provided the information.
  • How to Opt-Out of the Sale of Personal Information: We do not sell, share, or rent your personal information in any way.

For your protection, we may only process requests with respect to the personal information associated with the email address that you use to send us your request, and we may need to verify your identity before processing your request. We will respond to your requests within the timelines prescribed by applicable law.

 

When a business sells your personal information, you have a right to opt out of such a sale. eFraud Services Inc. does not sell, and in the preceding 12 months did not sell, California residents’ personal information. eFraud Services Inc. does not have actual knowledge that it sells personal information of minors under 16 years of age.

Authorized Agent

 

You can designate an authorized agent to make a request under the CCPA on your behalf if:

  • The authorized agent is a natural person, or a business entity registered with the Secretary of State of California and the agent provides proof that you gave the agent signed permission to submit the request.
  • You directly confirm with eFraud Services Inc. that you provided the authorized agent with permission to submit the request.

If you use an authorized agent to submit a request to exercise your right to know or your right to request deletion, please ensure that the authorized agent sends an email to support@efraudservices.com with the subject line “California request to delete” and includes the attachment of both the user in question and the Authorized agent’s ID with a notarized letter verifying the relationship (e.g., parent or guardian), and including detailed information about the requested data to be deleted.

 

If you provide an authorized agent with power of attorney pursuant to Probate Code sections 4121 to 4130, it may not be necessary to perform these steps, and we will respond to any request from such authorized agent in accordance with the CCPA.

 

  1. California Shine the Light

Residents of the State of California, under California Civil Code § 1798.83, have the right to request a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes from companies conducting business in California. Alternatively, the law provides that if the company has a privacy policy that gives either an opt-out or opt-in choice for use of your personal information by third parties (such as advertisers) for marketing purposes, the company may instead provide you with information about how to exercise your disclosure choice options.

 

This comprehensive Privacy Statement from eFraud Services Inc. provides you with details about how you may either opt-out or opt-in to the use of your personal information by third parties for direct marketing purposes. Therefore, we are not required to maintain nor disclose a list of the third parties that received your personal information for marketing purposes during the preceding year.
